Delaware Business Court Insider: Del. Supreme Court Disarms ‘Exposure Trigger’ in Asbestos Insurance Case

As reported by the Delaware Business Court Insider on September 12, 2016, Cohen Ziffer lawyers have secured another landmark decision for their client Warren Pumps LLC, this time from the Supreme Court of the State of Delaware, in Viking Pump. The publication notes that the Delaware Supreme Court ruled that Viking Pump and Warren Pumps “may seek excess insurance coverage for any asbestos injuries that occurred during insurers’ policy periods. In so ruling, the high court rejected a Superior Court’s ruling that limited [the companies] to recover under insurance policies in effect when the underlying plaintiffs first encountered the dangerous mineral, a proposition that has come to be known as the so-called “exposure trigger.” You can read the full report here.
