I always keep the ultimate goal of litigation in mind: to achieve the best results for my client while using resources effectively. I work hard to mitigate risks, resolve issues quickly, and support my client’s business operations. At the same time, I never lose sight of the human element inherent in these issues.

Overview

With comprehensive experience advocating for clients in large and complex insurance coverage cases, David J. Matulewicz-Crowley has shepherded multimillion-dollar cases from complaint to trial to successful verdict. He manages all aspects of litigation, inside and outside the courtroom and has served as first-chair in multiple trials. Serving primarily New York-based organizations but with a national practice as well, David focuses on first-party property matters and advises in commercial, directors and officers, professional, employment practices, and other liability cases. David also handles professional liability matters that often spring from insurance coverage actions.

David firmly believes that law is first and foremost about people. His keen emotional intelligence, listening abilities, and sense of empathy serve his clients well. Through making connections—with witnesses, opposing counsel, judges, and juries—David tends to uncover information and strategic insights that ultimately results in better outcomes for those he represents. He applies these insights together with his excellent writing, research, negotiation, and courtroom skills to all matters to achieve the best results for his clients.

David’s prior professional and life experiences greatly enrich and inform his current practice. At his previous firm he litigated complex insurance coverage cases involving a range of issues including products liability, soft-cost and delay in completion coverage, and environmental liability policies. David also served as in-house counsel for a multinational animal-welfare nonprofit, where he handled a myriad of questions, and challenges, gaining experience in intellectual property and labor and employment matters. Moreover, by serving as in-house counsel, David gained a valuable understanding of the client perspective.

As a self-described “insurance nerd,” David enjoys sitting down with policyholders to go over their documents line by line to pinpoint advantageous language and an optimal avenue for gaining coverage. He brings real and genuine passion to the pursuit of disbursements clients are rightfully owed and is happiest when his efforts are rewarded by deserved payouts to his clients.

Relevant Experience

  • As lead counsel, secured a $1.5 million jury verdict for a defrauded policyholder whose sunken cargo vessel was issued faulty insurance documents.
  • Served as second-chair in a $30 million insurance coverage jury-trial on behalf of a Las Vegas casino owner whose facilities sustained damage during a once-in-a-century spring hail-storm.
  • Defeated a motion for summary judgment in a $5 million first-party property action where the insured owner of a mid-town skyscraper suffered damage as a result of an electrical arcing event.
  • Obtained a favorable settlement through mediation for a commercial real estate developer who suffered delay-in-completion and soft cost damages to the development of their mid-rise condominium project in Brooklyn.
  • Defeated a motion for summary judgment on behalf of the owner of a stolen Ferrari, ultimately obtaining a favorable settlement for his client.
  • Prevailed in a bench-trial bankruptcy adversary proceeding against a debtor seeking to discharge the liability from an earlier fraud victory. His work does not simply end with a favorable judgment, he works to make sure his clients get the payment they deserve.
  • Represented Manhattan property owners in connection with a $30 million business interruption claim relating to civil authority orders encumbering their business operations.
