N.J. Transit Win in Hurricane Sandy Case

In 2019, Marc successfully represented New Jersey Transit Corporation in securing a victory in the Superior Court of New Jersey, Appellate Division. The appeals court affirmed the trial court’s ruling on summary judgment that the policies’ $100 million flood sublimit did not apply to the loss, and that the insurers could not reform the policies to negate coverage, such that NJ Transit was entitled to the full $400 million limit for its devastating loss from Hurricane Sandy.
