Robin Cohen provided commentary to Law360‘s article, “Mo. Restaurants Can Pursue COVID-19 Coverage Suit.” The article reported, “In an apparent first, a Missouri federal judge allowed a group of hair salons and restaurants to proceed with a proposed class action claiming Cincinnati Insurance Co. wrongfully refused to cover their losses during COVID-19 shutdowns, holding Wednesday that the businesses adequately alleged they suffered a covered ‘direct physical loss’.” Robin stated, “The carriers have strategically decided to try to not let discovery develop on whether the virus causes direct physical loss or damage, and they are trying to go in for the kill early. It is very helpful that the judge saw through what they were trying to do and took the issue head-on.”  Read the full article here.
